A white police officer in Fairfax, Virginia got charged with assault and battery on June 7th, 2020 after using a stun gun on a black man as announced by authorities.
According to body camera video, Fairfax County police Officer Tyler Timberlake used a stun gun while trying to get the victim into an ambulance so he can be helped out.
Officer Timberlake Strikes the Man Multiple Times
The video was shown at a press conference on Saturday in which Timberlake can be seen using the stun gun on the man multiple times. Somewhere during the incident the officer got on top of the man and fired his stun gun in his neck.
Fairfax County Police Chief Edwin C. Roessler Jr. said the community will heal together through transparency. He further mentioned that this type of behavior on part of law enforcement was intolerable in Fairfax and across the United States.
Police Were Responding to a 911 Call
Chief Roessler said that the officers were responding to a 911 call about a man walking on the street shouting that he needed oxygen. Another officer had responded to the situation before Timberlake and was trying to deescalate it.
The Chief said it was unclear why Timberlake used his stun gun. The man was taken to a hospital for treatment and was later released from there. According to Roessler, force deployed by Timberlake was in violation of the police department’s policies.
Fairfax County Commonwealth’s Attorney Steve Descano during the press conference announced that Timberlake is charged with three counts of assault and battery. This could lead to a 36 month sentence if convicted.
Descano assured the general public that he was personally keeping a close eye on the case to ensure a thorough prosecution and outcome.
Videos are Vital to Hold Police Officers Accountable
Law enforcement officials are here to protect and serve. The law requires all officers to use their powers and authority safely and responsible. While most police officers do a stellar job, there are a few bad apples in every police department. As a result, serious injury can be caused to citizens. It is important to speak with a police brutality personal injury lawyer when public servants abuse their power.
Video evidence is gaining widespread popularity in police misconduct lawsuits. This is because they show the exact nature of misuse of power by law enforcement officials and the extent of injuries sustained as a result of it.
Unfortunately, defense attorneys are crafty in their trade and can find loopholes in the law to render a video inadmissible as evidence. However, experienced and capable police brutality personal injury attorneys can help victims stand up for their rights.
