Just when you thought that the police misconduct situation in Illinois couldn’t get any more controversial, new questions are still being asked about policing in Illinois. Just recently, a lawsuit has been filed by an elderly couple, who were somehow mistaken for a team of bank robbers. They were then swarmed and arrested by police officers. While it’s true that “accidents happen,” you have to wonder how a mistake of this magnitude could possibly happen. These are professional law enforcement officers, after all.

This couple was able to file a lawsuit for those responsible. If you have experienced police brutality, you can sue the people responsible as well. Although police officers enjoy many legal protections, they are not immune from lawsuits. Team up with a qualified, experienced criminal defense attorney, and you can hold police officers accountable for their negligence. Your settlement can provide you with compensation for medical expenses, missed wages, pain and suffering, and much more.

How Could This Mistake Happen?

Details of this new lawsuit were highlighted in a report published in June of 2021. After receiving reports of a bank robbery at the US Bank in Oak Park in 2020, police rushed to the scene. The suspect was reported to be a single African American man. For some reason, police officers then chased an elderly couple. Despite knowing that the suspect was an African American approximately in his mid-30s, the officers seemed intent on arresting this elderly couple who had no idea what was going on.

Both of these elderly couples suffered from medical conditions. One had diabetes, while the other was nearly blind. Even when police clearly saw that these two individuals were not the suspect they were supposed to be looking for, they detained the elderly couple for more than 45 minutes. Interestingly, the couple decided to sue US Bank, and not the police officers who arrested them. They accuse US Bank of negligence, claiming that they failed to keep them safe. This couple has also vowed to never step foot in the bank again, and they are no longer customers of US Bank.

Statute of Limitations

It’s very important to take legal action as soon as possible if you have suffered from police misconduct. This is due to something called the statute of limitations, which limits a person’s ability to file a lawsuit after a certain amount of time has passed. When suing government agencies such as police departments, this time limit is shorter than usual.
